DEFINITIONS
 

In this Agreement, the following words and expressions (including the Specific Terms to this Agreement) shall have the meaning assigned to them in the list below, unless the context otherwise requires.
 

Agreement
The general terms and conditions, the specific terms and conditions, and any other document specifically incorporated into this Agreement in writing. 
 

Ministry
The Ministry of Commerce and Consumer Protection
 

MOPRI App
Mobile application developed by the Ministry of Commerce and Consumer Protection 
 

Users
Any person using the MOPRI App or the Website
 

Website
A website developed by the Ministry of Commerce and Consumer Protection
 

1. OBJECT
 

• The present Agreement defines the terms and conditions under which the Ministry shall provide the MOPRI App and Website to the public and under which the public may access and use them with due diligence. 
   
• The MOPRI App aims at helping users in their purchase decisions. The MOPRI App  may be used by users whereby they will be able to have more visibility on prices of certain products which will help them to take an informed decision.
   
• The Website  is provided for informative purposes only, whereby users  will be able to view baskets of goods, including the prices of same from 50+ retail outlets. Furthermore, users will be able to know the products that are being controlled by the Ministry. 
   

2. RESPONSIBILITY OF THE MINISTRY
 

• All information will be stored and used by the Ministry. Usage of user information includes sharing to other Government institutions under the Government of Mauritius. 
   
• User information may also be disclosed to the Police and other investigating agencies in accordance with Data Protection Act 2017.
   
• The Ministry may use cookies on the Website and on the MOPRI App for better user experience. 
   
• When users access the Website or MOPRI App, user personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. Users will be notified of the usage of cookies and may reject same, but such action could affect the availability and functionality of the Website or MOPRI App.
   
• The Ministry will ensure that the personal information/data is stored securely at the Government Online Centre (GOC), data centre of Government. 
   
• While the Ministry has taken reasonable steps to secure the personal information users provide, it is understood that no security measures are perfect or impenetrable, and that no method of data transmission can be guaranteed against any interception or other type of misuse. 
   
• It is also understood that any information disclosed online is vulnerable to interception and misuse by unauthorised parties.
   

3. USER RESPONSIBILITY
 

• Users may at any time review or change the information in user account. 
   
• Users can stop all collection of information by the MOPRI App by uninstalling the same.
   
• If user has opted to get notifications and wishes to stop receiving push notifications, the user can change the settings on his/her mobile device.
   
• By using the MOPRI App, the user is consenting to the processing of his information as set out in these Terms and Conditions now and as may be amended by the Ministry from time to time.

4. CANCELLATION 
 

A user may cancel this Agreement at any time by deregistering from the MOPRI App and/or inform the Ministry in writing.
 

5. FORCE MAJEURE
 

Neither party will be liable for any breach of this Agreement which is caused by a matter beyond its reasonable control and considered as force majeure by the laws of Mauritius.  
 

6. TERMINATION
 

This Agreement may be terminated by either party upon reasonable grounds and the Ministry shall discard the personal data of the user in concern in accordance with the prevailing Data Protection Laws. 
 

7. THE AGREEMENT
 

• Each party acknowledges that, in entering into this Agreement, they are bound by the terms and conditions of same. 
   
• The headings of this Agreement are for convenience purposes only, and shall not affect the construction of same.
   

8. COMMENCEMENT AND DURATION
 

This Agreement commences on the date the User sign in to the MOPRI App and continues until terminated by any party to this Agreement.
